The Animal Welfare and Management Strategy 2017-2022 states:
‘1. INTRODUCTION
Canberra’s setting as the Bush Capital means people living in and visiting the ACT have regular interaction with animals; whether it’s observing the variety of birdlife in our neighbourhoods, the threatened species in one of our many nature reserves, or kangaroos grazing in our open spaces.
The Territory’s significant network of open space and community facilities mean that Canberra is a great place to keep a companion animal.
As well as the intrinsic and companionship values that animals hold, they are sentient beings that have the ability to perceive and feel a range of emotions including pain, fear and joy. Animals cannot advocate for themselves and so it is our responsibility to do this on their behalf.
For these reasons, animal welfare is important. Everyone has a role in ensuring animals receive appropriate care and are treated humanely. This includes being informed about issues affecting animals, practising responsible pet ownership and avoiding impacts to native animals.
The Animal Welfare and Management Strategy 2017 – 2022 (the strategy) has been developed to ensure the ACT Government delivers a consistent and consolidated approach to promoting improved outcomes for animal welfare and management. In the absence of a targeted strategy, animal welfare and management practices are less likely to evolve to meet the changing expectations of the ACT community. The strategy will also be used to guide future government decision making and outlines all actions in a single document that can be easily accessed by the community.’ 
Note that the 3rd paragraph of the Strategy under 1.
INTRODUCTION, counting from the 1st paragraph in bold, declares all animals as ‘…sentient beings that have the ability to perceive and feel a range of emotions including pain, fear and joy.  Animals can not advocate for themselves and so it is our responsibility to do this on their behalf…
Domestic Animals
It is recommended that the Temperament testing be banned on animals at the RSPCA and DAS, and by anyone else who uses this inhumane testing on animals.
When these animals enter strange environments such as shelters, they are frightened being placed into hostile environments.  The last thing they need is strangers in their faces and in their space poking at them, tugging at them, pinching them, bullying them, harassing them etc.
If you ended up in a strange hostile and volatile place, the last thing you would want is to be harassed, bullied, with strangers in your face and in your space, pinching you, poking at you, tugging at you.  Animals feel the same way that you do.
Training to read body language is essential to understand when to back off and to leave the animals alone, when the animals are sick and need medical attention etc.
Do not force your dog to go for a walk when the dog does not want to go.

Last year a distressing incident occurred when I attempted to rescue/buy Lily, a Maremma from Domestic Animal Services (DAS).

Acts of animal cruelty on a 7 year old dog raised in Canberra when she had a good home to go to in Canberra if her owners didn’t want her back.  

Lily should never have been allowed to leave Canberra when she had a home to go to in Canberra.  Lily should only have been allowed to go to the Maremma Rescue Group if her owners didn’t want her back, if she had no home to go to in Canberra, or near Canberra to reduce more stress on her on a lengthy trip with still no home to go to being past around like a sack of potatoes from one place to another.
I phoned TAMS Manager on 21/11/16.  The female said it is not her job to order the DAS Directorate to do anything, in which case it is not our job to pay her wages since she failed to stop Lily from leaving Canberra and order that Lily be rehomed to me.  Instead the TAMS Manager allows the inhumane Directorate and DAS to do whatever they want to, which is not why she is being paid a wage for her highly waged job.
Photos were uploaded showing 2 Frightened Maremmas at DAS/Dog pound, Lily and Franklin, tail between legs by the same handler who complained to me that Lily was biting him who obviously was not removed from handling her.  If Lily would’ve been immediately released to me when I first went in to rescue/buy her, he would never have been bitten by her, if he would’ve been trained on how to read body language, and know when to back off, he would never have been bitten by her. LILY inhumanely kept at DAS for nearly 1 month. Lily is an old dog, she is 7 years old and has lived in suburbia all of her 7 years.

As if DAS’s actions not to release Lily from DAS on 11/10/16 wasn’t bad enough, DAS/TAMS Directorate and staff involved in sending this poor old dog to another rescue group rather than rehoming her immediately they got the opportunity on 11/10/16 is already an animal welfare matter/crime, it was further more inhumane of DAS to have this poor old dog transported to Pipers Flat that is a 5 to 6 hours drive from Canberra past Bathurst and to rip her out of her own environment that she has lived in for her 7 years of her life.

As of 9/11/16, Lily still was not and couldn’t be assessed because she was too unsettled and miserable at the Maremma Rescue Group.

Recommendations: Under the Animal Welfare Act, I will further ask to make it mandatory that the Maremma Rescue Group and any other Rescue Groups or people taking dogs from the pound speak first with the owners of these dogs that are at the pound/DAS, to first obtain the history of the dog and speak with the owners to confirm that the owners know where the dog is,and to consider the dogs age, before any dog is ripped out of their own state, etc. and to further find out whether someone from their own state has offered to take the dog and place the dog into a good home.  The Maremma Rescue Group should be the last resort.  We can not keep handing the same dogs to other rescue groups over exploitation, to auction the dog off to the highest bidder.

If the owners want their dogs back, then they should get their dogs back if they haven’t abused the dogs, or aren’t deliberately let out to roam by the owners, or the owners don’t walk the dogs unleashed to place their own dogs and other pets and people in danger.
There have been too many dog attacks, more recently a guide dog and an almost blind female who needs her dog to guide her at night when she can’t see who was attacked in civic by 2 unleashed dogs.

If the owners prove themselves to be loving, responsible and caring pet owners, then the dog owners should get their dogs back.

We went back to DAS on Monday 7/11/16 to check on Lily and to see Franklin to assess him, however they were both gone.

Lily was not going onto a property where she may be a risk to farm animals and stock. I don’t have any stock, she is too old for all of that anyway, and too old to be jumping fences, therefore all of their reasons are null and void for sending an old dog away from her homeland and refusing to sell her to me on 11/10/16. My property is secure anyway. I went back to DAS on Thursday 13/10/16 when she was still to be rehomed, please see attached photo I took of Lily. She was at the pound since 8/10/16. I went back again on Tuesday 18/10/16 with someone else when the rehomed sign was changed to ‘not for sale’ when I saw a real change in Lily due to being abused.

Recommendations: The temperament testing must be banned that is used by the RSPCA and dog/animal pounds, rescue groups,
they are inhumane. 
You wouldn’t like to be poked, pulled at, pinched, tormented, provoked, harassed, bullied by strangers in a hostile environment, you would lash out at them, animals are no different.
Body language makes all the difference that no one is trained to watch, and to listen to the animals, to know when to back off, get out of the animals face and their space, to leave them alone. 
The ban on temperament testing legislated in the Animal Welfare Act.

Under Animal Welfare, legal action needs to be taken against DAS over this case. 
They kept this old dog unnecessarily over a long period of time when she had a home to go to since 11/10/16 with me. She became stir crazy over being unnecessarily locked up in a small area for a long period of time and after being abused by DAS staff and the Directorate and TAMS who also refused to order to release Lily from her prison cell at DAS to me.

Franklin is apparently a farm working dog and will not be with Lily, as falsely portrayed by DAS and The Chronicle in their 1/11/16 edition, ‘Franklin has finally found a new home’, p.9 by Megan Doherty, however, since we didn’t see Franklin, we can’t confirm that he is a working farm dog.

By reading The Chronicle story on him, he is still a suburbia dog and not a farm working dog either. His age is not known that should be taken into consideration, he may be an old dog as well, in which case, it would be wrong to change his life style that he has grown up in.

Lily is a companion animal to live where she has access to go in and out of a house.

The history, the age etc must be checked before allowing any dog be ripped out of their environment and state.

I phoned Maremma Rescue Group twice on Wednesday 9/11/16 and spoke with the husband the first time for a lengthy time and then spoke with the wife for a lengthy time the 2nd time after he told me to ring back after dark to speak with his wife.

There are grounds to investigate Lily. The wife did not bother checking the history on Lily.

Lily’s history needs to be investigated on how the pound got her and why she wasn’t given back to her owner.

Franklin was not her mate.

The wife was told by DAS that the owner dumped Lily at the pound, I was told she was picked up as a stray and that it was the first time she was picked up. 

The owner needs to be found and contacted to find out the truth. I would like to be contacted with this information, or let me know who the owner is so that I can contact the owner.

Lily could’ve been let out by someone with the owners not knowing, maybe overseas, or not being able to afford to pay the pound, there could be a lot of other reasons, maybe the owners still don’t know what has happened to their beloved dog.

Lily was born in 2009 which makes her an old dog at 7 years old, DAS website showed that she was 2 years old.

The wife asked me why I didn’t buy her from the pound, I told her I tried. I already assessed Lily without touching her, I knew she was not suitable to be dumped in a paddock, (which is what DAS wanted to do, and then a breeding program when she is desexed and can’t breed) that she was a pet living in a house, Lily is a Canberra City dog, not a working farm dog, she agreed with me. The wife confirmed Lily is desexed and microchipped.

 The history of this dog needs to be investigated.

The Chronicle ran the article in their 1/11/16 edition, the husband told me they picked the dogs up either early November orlate October, his wife didn’t answer my question.

This poor old dog’s welfare has never been top priority by DAS and Directorate and TAMS. 
The dog should’ve been sold to me on 11/10/16 to end her misery in DAS. Maremma Rescue Group may not have had all of the required details and history, but then again, the wife told me that they don’t bother looking at the history of the dogs that they take and they don’t want to talk to the owners either before taking these dogs.

This is a welfare case with Lily against DAS.

The history run down with my experience and how the dog showed abuse by DAS staff towards her through her body language with each visit by me is as follows:
I checked the DAS website for dogs for sale and saw Lily’s photo.  The information on the website said that she was 2 years old.
11/10/16: I visited DAS.  Lily quietly walked up to me wagging her tail in her prison cell choosing me.  She was a quiet and gentle old dog.  Lily was the only dog not barking in the pound.  Her chart said that she was to be rehomed.  I went to the office and said that I would buy her.  DAS male staff refused to sell her to me and said that they decided 2 hours before I arrived that they were sending her to the Maremma Rescue Group in Bathurst and that she belongs on a farm.  I advised them that she does not belong on a farm, that she is a city dog and belongs in Canberra, obviously with me since she chose me.  I said that she is the only dog not barking, she is very suitable to stay here in Canberra and to go home with me.
I3/10/16: I returned to DAS.  Lily’s chart still said she is to be rehomed.  The Chart was amended to Thursday as the attached photo shows which I took on 13/10/16.  I again went to the office and said that I will buy the dog.  They again refused to sell me Lily this time the handler saying that she is biting him. I again said that she cannot go to Bathurst, she is not a farm dog, she is a Canberra dog and needs to stay here.  She has a home with me.
14/10/16:  I phoned DAS to enquire after Lily.  I spoke with a female and had a lengthy discussion with her and told her that I am animal welfare.  I advised her that the handler hates her, she can sense it, he is abusing her, he needs to be stopped from going anywhere near her.  I will buy the dog and give her a good home. 
18/10/16:  We returned to DAS.  The rehomed chart was changed to ‘Not for sale’.  Lily was still at DAS, I could see a drastic change in Lily.  She was cowering in the back of the cage and barking.  This time a female at the counter said that she is going to Bathurst to enter a breeding program.  She is desexed, she can’t breed.  I argued with her and then warned her that she better not kill Lily. 
18/10/16: I immediately phoned TAMS Minister after leaving DAS.  No answer.  I phoned Barr’s office and spoke with a female.  I sent emails outlining what had happened.  As you can see, no one stopped the ongoing abuse of Lily and inappropriate/inhumane imprisonment of Lily.  No one ordered DAS Directorate to immediately release this dog to me.  No one banned the handler from going near Lily or any other dog, no one sacked the handler.
7/11/16:  We returned to DAS to inspect Lily and Franklin and to assess them.  They were both gone.
After all of my phone calls and emails, no one stopped Lily from being inhumanely transported from Canberra to a 5-6 hour drive.  Lily’s welfare was no one’s top priority.
I am still able to work with Lily to regain her trust in humans.
3/12/16:  We returned to DAS.  This same handler that mishandled Lily is still employed by DAS,and still handling Lilly.

IN BRIEF: I visited DAS a few days after she arrived into the shelter when she quietly walked upto me wagging her tail that let me know we were a match.  Lily was the only dog that wasn’t barking in the Pound.
Rather than releasing Lily from DAS as soon as possible, DAS kept her unnecessarily for 1 month in this volatile environment where she went stir crazy.
This inappropriate action by DAS was not humane for Lily, a 7 year old companion dog that wanted to go home with me.  Dogs always choose who they want their owners to be and who they want to go home with.
I still have not had any answers to my investigation into Lily who was inappropriately shipped off past Bathurst, a 5 or 6 hour drive for this old dog from Canberra that lived in Canberra for all of her life that was a companion dog and not a farm working dog as DAS made her out to be.
She was shipped off with a male Maremma named Franklin that was assessed as being a farm working dog, therefore, neither of these dogs were being rehomed into the same environement together or spending the rest of their lives together.
I question whether or not Franklin was assessed correctly as a farm working dog, since he had never worked as a farm working dog either, he was also from Canberra, a city dog.  His age is uncertain.
Exploitation of this dog was evident with the Maremma Rescue Group charging $450 for her, $100 more than DAS, although since this dog was already desexed and microchipped, there had to be a huge reduction in DAS’s sale fees.
Exploitation and inhumane temperament testing by the RSPCA
On 23/12/16 we visited the RSPCA after they advertised dogs and cats for $99 until Xmas Eve.
We weren’t able to view all dogs to choose one.
When we tried to go into an area to see the dogs, we were told that we weren’t allowed to because they hadn’t been temperament tested yet.  How can people see if their missing/lost dog is at the RSPCA or not? 
We have found that the RSPCA and DAS don’t tell you that your dog is there when you ring up, they say that your pet isn’t there when described to them. 
I’ve advised owners to physcically go in and see if they can find their pet there who have then rung me back and said their pet was locked up in there after being told over the phone that their pet wasn’t in there.
If you can no longer see for yourself if your pet is there, and you are told over the phone that your pet is not there, you don’t get your pet back if it is there.
It is recommended that people be allowed to have access to all areas to view all the animals at the RSPCA and at DAS.
It appears that the RSPCA selected which dogs they would sell at $99 by Xmas Eve.
We then visited the cats.  I was particularly interested in the white cat named Swan advertised in the Chronicle on 20/12/16, p.9, title ‘When the gift has fur’, Animal Talk by Tammy Ven Dange.

Swan, the advertised white cat woke up when I approached her and came towards me.  She had a ginger cat in the same cage with her.
As we went to speak with staff, a female picked a kitten out to buy who was told that the kitten would cost her $301.  I corrected the female staff member and reminded her that they were on special for $99 until Xmas Eve.
The female staff member said that price was only for adult cats and dogs, and that they can easily sell kittens.
I phoned the RSPCA on Xmas Eve at approx 3.30pm and asked the female staff member if I could pay $99 for the white cat over the phone to prevent her from being euthanased and I would pick her up when they reopened again after Xmas Eve.
The staff member wouldn’t let me, she said the cat has to leave the shelter before they close at 4pm on Xmas Eve to sell her for the special price of $99. 
I couldn’t get there by 4pm. 
I was also then told that she can’t be sold without the ginger cat in her cage, that they came together, which was not advertised in the article in the Chronicle.  More deceit.
You couldn’t go into the RSPCA and spend $99 on one cat, you had to spend double the amount for 2 cats, and then there was no compromise by the RSPCA either to make sure that these cats could leave the RSPCA alive.
It is strongly recommended that the RSPCA not be allowed to employ CEO’s or anyone else who are not qualified in animal welfare, animal behaviour, etc.
It is strongly recommended to avoid animal exploitation that the RSPCA not be allowed to employ expensive CEO’s with this type of money being spent on proper care and treatment for animals, etc to introduce a nil kill at the shelter.
It is highly recommended that the sale prices of all animals be drastically reduced by the RSPCA, DAS, breeders and other rescue groups, etc to avoid ongoing exploitation of animals and to ensure that they are affordable by Pensioners and low waged income earners as well.  Cheap affordable sale prices, and in other cases, FREE animals will also ensure a no kill policy.
It is highly recommended that a Vetmedicare be established for animals and wildlife, equivalent to Medicare for people, to ensure that Pensioners and low waged income earners can access vets for high quality treatments, surgery when required etc for their animals, including wildlife.
Educating in Pets and Wills is also essential to ensure that Pets are cared for after their owners death.

It is highly recommended that Dog walking using long leads and long retractable leads be banned for use in public places.
Long leads were introduced to assist in training the dog in a secure environment such as in the dog owners own enclosed property as the dog is kept on the lead, the dog owner walks away, and then calls the dog to go to them on command.
If the dog doesn’t go to the dog owner on command, the lead is given a bit of a tug to encourage the dog to go to the dog owner when they call him/her.  When their dog does respond and goes to the dog owner, the dog is given a treat, a pat, a hug, while the dog is told what a good dog he/she is.
Long leads are a danger to the community.  There is no control over the dog.
Dogs have to be walked on a tight lead at a heel position to keep the dogs under control at all times and to prevent any harm to come to the dogs while being walked or to other people, pets, wildlife, etc.
Hefty fines for dog owners who are reoffending letting their dogs out unleashed and to roam.
An even heftier fine when the reoffending irresponsible dog owners know that their unleashed, roaming dogs are viciously barking, bailing up, and/or attacking pedestrians, cyclists, neighbours, responsible dog owners who are trying to walk their dogs on tight leads at a heel position, etc with the reoffending dog owners dogs removed from them and given to a responsible suitable loving, caring new home.
CIRCUS ANIMALS EXPLOITATION AND VIOLENCE
It is strongly recommended that the use of animals in circuses be banned because of exploitation and violent inhumane treatment of them.
Native Species.
With the Animal Welfare Management Strategy recognising animals as being ‘sentient beings’, it is strongly recommended that the 2017-2022 Strategy is not in compliance with:
1. the violent Nature Conservation Act 2014 removing all ag gag type sections from the Act.
2. the violent Eastern Grey Kangaroos Draft Controlled Native Species Management Plan that persecutes and drives the native Eastern Grey Kangaroos to extinction and endangers public safety shooting any time and day with the violent killing that is not for conservation purposes but for development:

(1. Kangaroos do not overpopulate. Their populations grow until they are in equilibrium with their environment and then stabilise (1, 2.) – an Eastern Grey Kangaroo doe only raises its first joey to the pouch-emergent stage by 3.5 years of age, and finishes breeding at around 12 years of age, she is only likely to produce 8 young in her lifetime.

75% of joeys are likely to die, this leaves only 2 young to survive to adulthood. If the male female sex ratio is parity, only one surviving joey will be a doe, and on average the original female will only effectively replace herself once in her lifetime – parity means that if a doe first conceives at 3 years of age, and has its first young to independence by 4.5 years of age (this assumes success in rearing, and ignores the very high reported juvenile mortality rates), 50% of the time it takes a minimum of 4.5 years for a doe to replace itself with a female offspring. If the doe has a male joey, it will be another 12 months before there is another 50/50 chance she will replace herself with another female. Pouch young sex ratios from Hacker et al (2004), being roughly parity (which was also concluded by Coulson, Kirkpatrick, Poole and Pople / Grigg, however Dawson (1995) identifies that both Eastern and Western Grey Kangaroos seem to experience higher mortality in the males, with only 5% surviving to full maturity (c. 60kg) in the wild.


 2. When food is scarce kangaroos stop breeding and move on to greener pastures (3).

 3. As admitted in the KMP itself (p12), kangaroos are a keystone species. This means that, at natural densities (which vary with climatic and seasonal variations), they are critical to maintaining all the other native plants and animals which share their habitat. Killing kangaroos is not protecting threatened species. It is further endangering them.

 4. No base-line studies have ever been conducted in the ACT to determine how many kangaroos are needed to maintain healthy populations of other native species.
The kangaroo slaughter is conducted at a time of year when, according to the KMP itself (p10-11), almost every mature female kangaroo has both a pouch young and a young at foot in her care. It is conducted under a code of practice which exists for the purpose of permitting acts of cruelty that would otherwise be prohibited by law (5).

This pictured Joey was a suffering victim by the ACT Government’s annual cull that was shot, stabbed, bashed, and while still alive, was then buried alive. The Cause of an agonising death and endless suffering was asphyxiation as shown by the Vet Report:

The mass killing and infertility program is interfering with, and genetically altering the Kangaroos natural development, weakening the species and driving them to extinction. 

‘The kangaroo massacre destroys the process of natural selection. The repeated targeting of the ‘alpha’ males, the largest and fittest animals (who provide the industry with the big skins they want),’ [and that the Government also target in their violent unnecessary killing based on fiction] ‘means younger, smaller animals are left to breed, weakening the gene pool. “This has the potential to cause the extinction of a number of species”. (Dr Ian Gunn, Animal Gene Storage Resource Centre of Australia.) Australia has the worst wildlife record in the world – six species of kangaroos extinct, four more extinct on the Australian mainland, 17 species endangered or vulnerable.’

If the doe has a male joey, it will be another 12 months before there is another 50/50 chance she will replace herself with another female. Pouch young sex ratios from Hacker et al (2004), being roughly parity (which was also concluded by Coulson, Kirkpatrick, Poole and Pople / Grigg, however Dawson (1995) identifies that both Eastern and Western Grey Kangaroos seem to experience higher mortality in the males, with only 5% surviving to full maturity (c. 60kg) in the wild.

2. When food is scarce kangaroos stop breeding and move on to greener pastures (3).

 3. As admitted in the KMP itself (p12), kangaroos are a keystone species. This means that, at natural densities (which vary with climatic and seasonal variations), they are critical to maintaining all the other native plants and animals which share their habitat. Killing kangaroos is not protecting threatened species. It is further endangering them.

 4. No base-line studies have ever been conducted in the ACT to determine how many kangaroos are needed to maintain healthy populations of other native species.
The kangaroo slaughter is conducted at a time of year when, according to the KMP itself (p10-11), almost every mature female kangaroo has both a pouch young and a young at foot in her care. It is conducted under a code of practice which exists for the purpose of permitting acts of cruelty that would otherwise be prohibited by law (5).

This article in the Sydney Morning Herald reports that the violent infertility program cost $612,000.

In 2011-2012 the Directorate of Environment and Sustainable Development published their records that $244,750 was spent on the Canberra violent Kangaroo killing.
This figure would’ve more than tripled up to 2017 that is ongoing abuse of taxpayers money and their positions committing professional misconduct on unnecessary violent killing based on fiction.
‘Earless Dragon scarcity previously coincided with kangaroo scarcity in ACT
Don Fletcher, in “Population Dynamics of Eastern Grey Kangaroos in Temperate Grasslands,” describes how, in the 1940s and 1950s kangaroos actually became rare in the ACT due to competition by European grazing stock. Even when these stock were removed, they remained rare for some time. Salt blocks were put out in the 1960s to attract kangaroos to the Tidbinbilla Fauna Reserve, where in 1963 employees went for three months without seeing one.) [12]
Oddly, at the same time as kangaroos were banished from the ACT, the Earless Dragon also became scarce. It couldn’t have been because of too many kangaroos.
“The Grassland Earless Dragon was very common in the ACT up to the 1930s but there are now very few left. This is mainly because there are so few areas of its native grassland habitat remaining. Don Fletcher’s same PhD documents also state that they were regularly killing Kangaroos  in one fenced off area that caused the Kangaroos to become smaller that shows that the mass killing and infertility program are interfering with and genetically altering the Kangaroos natural development and weakening the species, driving them to extinction.  This is criminal.
Research has already been undertaken, with one section being fenced off with no Kangaroos. The vegetation in this section died off because there were no Kangaroos in the fenced off section due to no grazing, stimulating the vegetation to regrow.
Another section was fenced off with the soft footed Kangaroos grazing in there. The vegetation in this section thrived due to the grazing of the Kangaroos, stimulating the vegetation regrowth.
This clearly shows that Friends of Mount Majura – FOMM have their story back the front in the article in the Canberra Times (CT) on Friday 22 March 2013, ‘News’ Section p.7 with the subject heading ‘Majura roos in sights of cullers’ written by John Thistleton and Larissa Nicholson .
Kangaroos and the grazing of the Kangaroos is extremely important as the Kangaroos only skim off the highest, tough growth of plants, exposing tender shoots, stimulating vegetation regrowth, saving the grasslands, habitat and the endangered native flora and fauna species that live there.
The soft footed Kangaroos cause no environmental damage and maintain a healthy well balanced eco system.
The mass killing and infertility program is unlawfully genetically altering the Kangaroos weakening the species and driving them to extinction.

Animals used in racing.
It is strongly recommended that the violent Greyhound Racing Industry be banned.

This Brush-tailed Possum Joey was used in live baiting showing the Greyhound Racing Industry in a short film, dragged along the ground, spinning around on the ground while being chased. This Brush-tailed Possum Joey’s tail can be seen stick in up in the air and then flat on the ground while being dragged and rolling around along the ground, while being chased by the Greyhound, cast, and film crew.

It is strongly recommended that all racing, recreational and sport activities using animals be banned to prevent the exploitation of animals and the violent treatment that they suffer.
If they aren’t fast enough, if they are injured, they are treated as liabilities, they are either inhumanely treated, neglected and/or inhumanely destroyed.

ANIMALS USED ON SETS FOR FILMING, etc

It is strongly recommended that the use of animals on sets, etc be banned
With modern technology available in being able to digitally prepare life like looking animals, it is completely unnecessary to exploit animals and cause them unnecessary stress, suffering,harm, and in a number of cases violent deaths.
2007 Australian Film ‘ROMULUS, MY FATHER’, starring Eric Bana burying the live hens scene was real.  Live hens were shot at and buried alive.
The 2008 Baz Luhrman feature film ‘Australian’, starring Nicole Kidman, shooting a Red Kangaroo on set, then driving around with the dead Kangaroo tied up on the 4WD.

RECREATIONAL, FISHING
It is highly recommended that these activities be banned.  These activities are not sport. 
Fish are also sentient beings that feel pain the same way that people do: 
Carelessly discarded fishing lines, fish hooks etc cause suffering and a slow death in other water wildlife such as Tortoises, and water birds, etc.

Agriculture, Farm Animals
Farmers over stock causing suffering and a slow death to their farm animals, and don’t call on vets to treat their injured and suffering animals that get caught up in fences, get stuck in dried up muddy water holes, the animals may be pulled out of the mud with great difficulty, but then the farmers just walk away and leave them to slowly die covered in mud, injured and slowly starve to death, slowly starve to death when their paddocks are grazed to dust, with the licks not helping to feed them, and suffer and slowly die from dehydration when the water dams dry out with not enough checks done in time to fill up the water holes for the farm animals such as sheep and cattle, etc. to be able to survive.
It is recommended that a policy be drawn up on how many sheep, cattle, etc farmers are allowed to keep in order to prevent over stocking of animals, and kept at a minimum number that farmers can cope with to prevent over grazing, lack of water and suffering to the farm animals.
It is highly recommended that farmers be educated in how to live with wildlife, and not to be allowed to kill them.
All Native Wildlife, macropods, including Eastern Grey Kangaroos maintain a healthy well balanced eco system.

The mass killing and infertility program is  interfering with and genetically altering the Kangaroos preventing the species natural development, weakening the species and driving them to extinction.  The same applies to all other native wildlife that the Government is interfering with.

This statement is admitting to the flawed, dishonest kangaroo management plan, and russell watkinson’s media release, on Friday 18/6/10, that blames the kangaroos for driving legless lizards, earless dragons, etc, and the deteriorating grasslands and woodlands to extinction, by eating all the grasses, when fletcher admits that the native grasses are not threatened by the kangaroos, but by human activity, including toxic sprays.

The code of practice that the shooter refers to is inhumane, and unacceptable, as witnessed in this video footage. Kangaroos are not fit for human or dog consumption, heavily contaminated with various diseases/harmful bacterias, e.coli, salmonella, staphylococcus, streptococcus, toxoplasmosis, preserved illegally with sulphur dioxide that causes thiamine deficiency, (a white crystalline solid forming part of the vitamin B complex, C12H17CIN4OS; a vitamin (B1), required by the nervous system, absence of which causes beri-beri and other disorders), causing death, intake of pesticide spraying to control locusts, etc. Keep watching till it stops, keep an eye on the timer, next to the speaker symbol, length 10:59.

The Government has always continued the killing after their own killing by placing poison baits in all the nature reserves, and then putting hooved cattle and sheep that cause irreparable damage to the biomass and endangered species named by the Government, into the nature reserves to graze down the grass to prevent a fire hazard, which the soft footed Kangaroos, that don’t cause any damage to the biomass, do if they are not misrepresented, not mismanaged, and not killed.  This is after all suppose to be the bush capital and not the farmers capital.

First the Eastern Quolls were released where the Bettongs were fenced in at Mulligans Flat so that the Government can abuse and waste more taxpayers money and get the Bettongs violently killed by the small Eastern Quolls, where they have no escape.

Because of the ongoing misrepresentation and mismanagement, and fraudulent reports repeatedly written about our Eastern Grey Kangaroos by the Government that is then illegally sent out to the media by the Government, it is not recommended that the EGK’s status be amended to a controlled native species under the Nature Conservation Act 2014, and that the controlled native species status be immediately removed from the Nature Conservation Act 2014, and under these conditions, it is highly recommended that the Government abort the Controlled Native Species Management Plan.

FURTHER UPDATES BELOW: My apologies for WordPress who have compressed most of these reports by removing paragraphs, spaces etc and unfortunately have reformatted my original properly formatted reports.  I have attempted to tidy up this report by adding more photos and our banner. I have updated the kangaroo numbers and charges against the government to include 2015 unlawful violent kill since writing these reports including adding more photos.   Unfortunately the unlawful violent slaughter did go ahead in 2015 commencing 30 April 2015-7 July 2015 – 1700+701 Joeys=2401 violently killed by the ACT Government annual kill, that does not include the other 93 permits handed out all year round or the infertility program that is preventing breeding, weakening the kangaroo species, driving them to extinction.

In 2015 the ACT Government authorised the slaughter of at least 25772 Kangaroos across the Territory. Most of these were to be killed on farms because farmers incorrectly believe that native Kangaroos compete for pasture with introduced livestock. But 5000 of the 25772 were to be killed by the government’s own hired guns on public reserves. Kangaroos maintain a healthy well balanced eco system.

 

In 2014 the ACAT Legal action against the government exposed that the government’s own ecologist admitted that the government’s assertions about kangaroos being a threat to vulnerable species were just “PR”, and that its claim that killing kangaroos will benefit biodiversity generally is based on a simplistic assumption that more biomass (vegetation) is better for biodiversity than the diversity of vegetation achieved by kangaroo grazing.  The TAMS Senior Ecologist had already researched the fact that the vegetation in the fenced off areas where the Kangaroos were kept out of had died because the vegetation actually needs the Kangaroos general grazing in order to survive and thrive.  The vegetation in the fenced off areas where the soft footed Kangaroos were allowed to continue their gentle grazing survived and thrived.

RSPCA Vet report on 2 of the stolen Sulphur-crested Cockatoos from my property on 10/8/12 stating that the RSPCA committed acts of animal cruelty to them while stealing them from my property on 10/8/12 during their unlawful trespassing/entry, damages. The amount of blood I had to clean up after the RSPCA shows that the RSPCA Vet report is covering up the extent of the injuries that the RSPCA caused to the birds.

The unlawful entry and stealing of my wildlife from my property by tams, the rspca and the police occurred as a result of me taking the Conservator of Flora and Fauna to court for the unlawful violent killing of the kangaroos/animal cruelty in 2012, to stop the unlawful violent killing and to have the Acts and policies that govern these policies changed. This action against me was more abuse of taxpayers money and vexatious by the government.
TAMS, Marg Peachey, who has now started up her own wildlife group as President that would be affiliated with TAMS, is a TAMS Government wildlife group, and is affiliated with the RSPCA with the same RSPCA mobile number, and the RSPCA are not fit to work with or take and have/keep any animals, and are not fit to be writing up Acts and Policies on them either. Marg Peachey now employed by TAMS, formerly RSPCA Wildlife Manager mistreats animals throwing them around as though they were objects, and is more interested in removing native wildlife from the Wildlife Rehabilitation Licence that she hates, who also misguides with her training who also teaches mishandling of animals.  This corrupt government, government departments and the RSPCA abused more taxpayers money, by raiding me, defamed me with vicious lies to get me out of the way while I fought back for vindication and for the protection and safety of our wildlife, so that Marg Peachey could start up her own TAMS Government wildlife group as well as what the above paragraph states, for taking legal action against TAMS, and so that they can continue to tell lies about the Kangaroos and keep on unlawfully killing them.
The ACT Government, TAMS, and the RSPCA have abused more taxpayers money to allow Marg Peachey to start up another wildlife group, when they already had my established group that saves taxpayers money since we are all volunteers.  I have long term expertise and knowledge of over 30 years in wildlife. I had to stop Marg Peachey from removing protected native Brush-tail Possums and protected native Currawongs from the Wildlife Rehabilitation Licence while she was the RSPCA Wildlife Manager, purely because she hated them.  I had to seize back a magpie that needed surgery from Marg Peachey while she was the RSPCA Wildlife Manager because all Marg wanted to do was to kill it .

On 7/7/13 I was prevented from personally helping a Joey, as animal cruelty continued by TAMS and was committed by a TAMS ranger named Grant who went out and saw a Joey in Oxley that was mauled by 2 roaming dogs. He failed to sedate the Joey and immediately provide the Joey with veterinary treatment for the injuries, and shock, and to ensure that the Joey was rehabilitated by a responsible experienced person, such as myself, prior to release. Instead, he told a resident that if the Joey didn’t hop away by 8/7/13 that he would kill it. This is completely unacceptable and unlawful.

According to the caller,the dogs dragged the Joey across the road, and was therefore injured and suffering myopathy (shock).
The callers phoned me being dissatisfied with the TAMS Ranger Grant’s non action, and asked me to help them to help the Joey. I phoned a rescuer and asked him to sedate the Joey, rescue it, and to immediately get it to have medical treatment and rehabilitation. The ranger then phoned me and left me a threatening message demanding that I phone him back, that he had already attended the site where the Joey was, and that I was to stay away and leave the Joey where it was, to suffer. I refused to phone Grant back.

TAMS and CSIRO were fighting over an endangered Major Mitchell Cockatoo that was someone’s pet that had escaped. THEIR FIGHT WAS OVER who was going to torture this poor bird to death by draining the blood out of it while it was still alive and conscious, after TAMS seized it from a wildlife carer who was happy to keep the bird as his pet if the owner didn’t come forward. THIS WILDLIFE CARER IS NOW DECEASED. TAMS violently kill everything. No wildlife can be given to TAMS OR THE RSPCA. Under my conditions of my licence K8464 No.4, it stated that the animals shall not be sold….., however, the RSPCA is selling the animals, adopting out animals is the same as selling them, the RSPCA are making a profit from wildlife, including mine that they stole from me, and what they couldn’t sell, adopt out and profit from, the RSPCA killed. The RSPCA have contravened other conditions of their licence as well as in failing to provide veterinary treatment and care, including surgery when needed, who instead kill.

Condition 28 of the licence K8464 is requesting that: “The Wildlife Foundation shall maintain and submit to the Conservator of Flora and Fauna: 1) A current list of names and addresses of members of the Foundation and 2) Records of all animals received by the Foundation by June 30 each year. These records shall contain: 1. Date and where animal found 2. Name and address of person delivering animal 3. Species and sex of animal/s 4. Date animal received 5.Treatment provided and 6. Date of animal’s release, or name and address of person animal delivered to and date delivered.”
This means that my licence should still be valid and extended/a continuance which can be done under special conditions and backdated to 2008/2009.

Since TAMS were requesting condition 28 information from another group when they falsely gave condition 28 of the licence as not being complied by, and as their reason for not issuing a renewal, even though I still complied with that condition, and since condition 28 is not referring to Wildlife Carers Group, then the licence K8464 still has to be valid if they want to continue to falsely deny that they received everything as requested.
I was advised by the court to ignore condition 28, however TAMS have been using condition 28 not to renew my licence, to defame me to my carers, vets, etc, which they cannot do.
The only condition I contravened on the licence K8464 was in condition No.28 by giving TAMS a list of vets and carers names, records, etc when condition 28 was asking the Wildlife Foundation to give them their list of vets and carers names, records etc. All of TAMS evidence shows that I was bullied and threatened by TAMS in giving them that information in contravention to condition 28 of my licence which I gave under duress and is therefore inadmissible in court.

I repeatedly advised the licensing officers that they have also erred in the licence by naming the Wildlife Foundation which they repeatedly ignored, as they repeatedly ignore everything else. Therefore, as I have repeatedly stated, this is all departmental error by a dysfunctional department. Neither myself nor the animals can be allowed to suffer the consequences, or hold me and the animals responsible for TAMS repeated errors and contravention to the Act, the Animal Welfare Act and the Code of Practice etc. any further.
I believe that I have suffered enough intimidation, torment, bullying (upto $600,000 fine), humiliation, degradation, defamation, vicious harassment and violated by these departments and the RSPCA over false allegations, etc for over a long period of time that dates back to 2004 when I first applied for the Wildlife Rehabilitation Licence.

Science tells the ACT Government to leave the Kangaroos alone because without the soft footed macropods and their gentle grazing to stimulate native vegetation growth along with their natural fertilisation through their faeces, the vegetation will die. The ACT Government is driving the Eastern Grey Kangaroos to extinction with their over killing, lies and mismanagement. The strong large males and strong healthy females are targeted destroying their strong healthy gene pools, weakening the species. On top of the 31+ killing permits, predators, the ACT Government is also sterilising the Kangaroos to completely wipe them right out and to speed up the process of driving them to extinction. The ACT Government’s lies about the Kangaroos is encouraging violence who are committing fraud with their false reports. The Kangaroos are not over grazing and there is such a small population left. The kangaroos are not of an abundance. The ACT Government hand out approx. 30 permits a year to land holders to kill the Kangaroos, along with their own annual unlawful killing that would add up to approx. 31 killing permits of protected native wildlife a year. Kangaroos and other macropods predators are dogs, raptors, foxes, snakes, humans, road kills, development/construction, fences, loss of habitat that are keeping the population well below the required population to provide a healthy well balanced eco system. The ACT Government is destroying the habitat and driving the Eastern Grey Kangaroos, other macropods, reptiles, insects and other wildlife to extinction through poisoning – baits and sprays, unlawful killing throughout the year, construction of roads and buildings, driving quad bikes, heavy machinery, and trucks throughout reserves, digging up the reserves for trenches etc. who are destroying the Bush Capital. After each ACT Government killing, they then spread poisonous baits throughout all the reserves to finish off the last remaining Kangaroos and other native wildlife. The ACT Government is driving our Kangaroos and other native wildlife flora and fauna to extinction. Updated from top to bottom with more relevant photos to show the extent of the ACT Government’s and the RSPCA’s violence and lies. The ACT Government are weakening the species by targeting the large males and strong healthy females that hold the strong gene pools.

It is common along the eastern seaboard, from northern Queensland to South Australia and Tasmania, with a local population in Perth (Western Australia), initiated from aviary releases, that is now found in the ACT as well due to habitat loss. Its habitat is rainforest, coastal bush and woodland areas.  Both sexes look alike, with a blue (mauve) head and belly, green wings, tail and back, and an orange/yellow breast. The Rainbow Lorikeet mostly forages on the flowers of shrubs or trees to harvest nectar and pollen, but also eats fruits, seeds and some insects. The eggs of the Rainbow Lorikeet are laid on chewed, decayed wood, usually in a hollow limb of a eucalypt tree. Both sexes prepare the nest cavity and feed the young, but only the female incubates the eggs.

GREYHOUND RACING CRUELTY UPDATE: Racing Queensland has banned six Greyhound trainers for life and suspended 27 trainers from the industry over live-baiting and 14 people have been arrested on 53 charges, including 37 of serious animal cruelty. The inquiry’s report is due before June. Here are Questions and Answers in the Legislative Assembly for the ACT on Greyhound racing-live baiting on 18-19 March 2015: ‘MR SMYTH: My question is to the Minister for Racing and Gaming, Minister, on 17 February you described the reports on live baiting in the greyhound racing industry as “truly shocking” and said that you had ordered the commission to investigate the matter further, Minister, have you ordered the commission to investigate this matter?  If yes, when? If no, when will you order this investigation, and will you table the terms of reference? MS BURCH: I have had discussions with the commissioner about this.  It is my understanding that he has spoken with the greyhound club or some of his officials have visited the site.  One of the key questions I had was: do any of the trainers or owners that were recognised in that Four Corners report have connections here? It is my understanding one trainer was identified in that report that raced here two or three years ago. This is something the commission will have an eye to over time.  I am happy to bring advice, as this is something the public has a strong interest in.  I know many members in this Assembly have had a  lot of correspondence damning the practice, which was absolutely disgraceful.  I have confidence that the greyhound industry here abides by all the integrity that the code of conduct of the industry requires. MADAM SPEAKER: A supplementary question, Mr Smyth. MR SMYTH: Minister, when you directed the Gambling and Racing Commission to make inquiries as to whether interstate trainers who use live baiting had operated in the ACT, what were the outcomes? Will you be issuing a report from the review that is being conducted? MS BURCH: I think I indicated in my first answer that there was one trainer identified that was here once.  But I will get an update, and I am quite happy to bring back, probably tomorrow, at the end of question time, some information about where that is up to.  Will I be issuing a report on it?  I had not planned to, but I think a statement in the Assembly tomorrow, following question time, with an update, would suffice. MADAM SPEAKER: A supplementary question, Mr Doszpot. MR DOSZPOT: MINISTER, HAVE YOU WRITTEN TO YOUR INTERSTATE COUNTERPARTS TO PRIORITISE THE ISSUES OF ANIMAL ABUSE IN THE GREYHUND RACING INDUSTRY IN YOUR NEXT MEETING WITH THEM? WHEN DID YOU DO THIS? WHAT WAS THE RESPONSE? MS BURCH: Yes, I have written. Tomorrow, when I bring the advice, I am quite happy to table a copy of that letter.  The meeting was actually scheduled for sometime in May.  Advice has come through to my office today that has been deferred.  So unfortunately, I will not have a chance to have a face-to-face discussion with my colleagues on that because the meeting has been bumped to no fixed date in the future. MADAM SPEAKER: A supplementary question, Mr Doszpot. MS BURCH: I am confident, and the advice to me is, that there is no baiting-absolutely no baiting-here in the ACT. But, as I have said, I am quite happy to come back with an updated bit of advice tomorrow.’ Cont’d – March 19: ‘MS BURCH: Yesterday, in regard to greyhounds there were a number of questions from those opposite.  While the ACT Gambling and Racing Commission is responsible for the regulation of gambling activities, the Canberra Greyhound Racing Club, under the auspices of Greyhounds Australasia, is responsible for the conduct of greyhound racing and the registration of owners and training. In December 2013 the government signed an MOU with the Canberra Greyhound Racing Club so that we can maintain strong integrity in relation to the code of conduct and the discharge of their duties.  The commission has been working with the Canberra Greyhound Racing Club to ascertain whether any identified or banned owners or trainers from other jurisdictions have attended race meetings held by the club.  It has also initiated inspections of the venue and attended race meetings and training sessions to monitor that. The commission has ascertained that one trainer currently under investigation in New South Wales previously raced in the ACT, back in 2013, and that person is currently suspended in New South Wales, pending an investigation.  Earlier in March this year the commission then received further advice that one suspended Victorian trainer had raced in the ACT.  The Greyhound Racing Club have advised that that trainer had attended cup meetings but there is a watch on that future activity. Racing Queensland announced that an additional 23 trainers have been suspended, and the Canberra Racing Club are looking to see if there is any connection back here to Canberra, but nothing as yet.  The commission is continuing to liaise with the Greyhound Racing Club, and no complaints have been received by the commission in relation to live baiting in the territory. There was a question over letters.  I am quite happy to table the letters that I have written to my counterparts in regard to greyhound racing.  I present the following paper: Greyhound Racing Industry Standards-ABC’s Four Corners program- Correspondence to State and Territory Ministers for Racing, dated 2 March 2015.’

Heartbreaking news of the death of Berani, died on Monday 20/4/15.  NZ&A are still waiting for the autopsy to find out the cause of death after he suffered for a couple of weeks. SUMATRAN TIGER (Panthera tigris sumatrae) is the smallest and a rare tiger subspecies that inhabits the Indonesian island of Sumatra. It was classified as critically endangered by IUCN in 2008 as the population was estimated at 441 to 679. Kangaroos are not fit for human or dog consumption, heavily contaminated with various diseases/harmful bacterias, e.coli, salmonella, staphylococcus, streptococcus, toxoplasmosis, preserved illegally with sulphur dioxide that causes thiamine deficiency, (a white crystalline solid forming part of the vitamin B complex, C12H17CIN4OS; a vitamin (B1), required by the nervous system, absence of which causes beri-beri and other disorders), causing death, intake of pesticide spraying to control locusts, etc. Keep watching till it stops, keep an eye on the timer, next to the speaker symbol, length 10:59. A Moratorium on Kangaroo Killing in the ACT

The Animal Justice Party of Australia opposes the killing of kangaroos in the ACT by
your Government on three groun
ds: a) there is a serious decline in kangaroo numbers across the
ACT as a whole
, and on its nature reserves, with numbers drastically lower than the levels your
Government has its
elf advocated were needed to sustain its grasslands and its kangaroo
population, b) the killing program your Government has imposed involves gross animal cruelty
ofthe most grotesque kind, and c) the availabi
lity of successful ethical noharm alternatives
and exper
tise to implement them, including experience within the ACT, in situations where
kangaroo habitat ha
s been significantly compromised. At a minimum, the AJP calls for a
moratorium on the killing of kan
garoos until these matters are more properly considered by
yo
ur Government.

Last year, ACT Greens MLA Mr Rattenbury, now one of your Ministers, said he would
we
lcome independent research into estimates of kangaroo numbers in ACT nature reserves.
Thi
s research is nearing completion and early results have already been given to Mr
Ra
ttenbury. You and Mr Rattenbury have also in the past been presented with autopsy
ev
idence (from a highly respected forensic wildlife veterinarian) of severe brutality resulting
from the Government’s killing program last year. The availability and success of no-harm
al
ternatives such as translocation, including in the ACT and more widely, has also been brought
to the attention of both you and Mr Rattenbury.

We are disturbed now to read in The Guardian newspaper that Greens Minister Mr
Rattenbury has said: Without a predator, kangaroos have increased their abundance and have a
detrimental impact on the rest ofthe ecosystem’ , and the Greens have not opposed that cull’. If
Mr Rattenbury has peerreviewed and authoritative evidence that kangaroos have a detrimental
impact on the ecosystem why have we never been able to see it and have it independently
scrutinised? Where is the evidence of apparent ecosystem improvement from the previous four

years of kangaroo killing? This has been asked for many times and has never been
forthcoming. Clearly, Mr Rattenbury and the ACT Government are conveniently choosing to
ignore human ‘predation’ (housing and commercial development, killing programs) and their
vehicles and guns, wire fencing, out-of- control dogs and degraded habitat due to weed
infestation. The chance of a newborn kangaroo infant reaching maturity is now less than 20 per
cent
. If significant public funds are being spent on killing kangaroos to supposedly improve the
local ecosystem, the public needs to be able to scrutinise the results of this expenditure.

Mr Rattenbury, the ACT Greens and your Government have supported the brutal killing
of kang
aroos for four years. This is just one of many reasons why this country desperately
ne
eds an Animal Justice Party so that animals have an honest and passionate voice in this
country’s parliaments where decisions are made that impact on their wellbeing. This is the
reason why the AJP is standing ten candidates in the forthcoming federal election on September
14
, including for the Senate in the ACT, and why it will contest all jurisdictional elections,
including in the ACT
, from now on.

Attached (Attachment 1) you will see evidence from respected consulting wildlife
ecologist Ray Mjadwesch, author of the highly influential 2011 report: Nomination to List the
Large Macropods as Threatened Species under the NSW Threatened Species Conservation Act
1995. Mjadwesch says the numbers of kangaroos in the ACT are far from abundant and have
plummeted by around 75 per cent since white settlement. Indeed, there are now areas across
the ACT where kangaroos are locally extinct, or are threatened with local extinction
.

Mjadwesch’s analysis concludes:

28.3 per cent ofthe ACT is unsuitable habitat for Eastern Grey Kangaroos (EGKs) on
account of stee
p terrain, incorrect vegetation types etc.

• Eastern Grey Kangaroos are extinct in 20.5 per cent ofthe ACT, on account of human
occ
upation (city and suburban areas, and heavily modified rural landscapes)

• Kangaroos are under pressure across 29.9 per cent of the ACT, from agriculture (loss of
habitat and shooting), shooting in nature reserves, and from the softwood industry
(loss
/disruption of habitat)

• Kangaroo habitat in which EGKs are effectively conserved now occupies only 21.3 per
cent of Australia’s capital territory, down from 71.7 per cent of the ACT in 1788.’

This datasupported evidence stands in stark contrast to the ACT Governments own data
a
nd Mr Rattenbury’s statements suggesting ‘abundance’. There is no abundance of kangaroos
in the ACT. It is an urban myth perpetuated by those with a poor regard for our nation’s iconic
wildlife
. For this reason alone there is serious cause for concern and a need for a moratorium on
killing kangaroos to enable fuller investigation.

On Mr Rattenbury’s invitation last year, ACT citizens concerned about its wildlife have
been undertak
ing independent kangaroo counts on Canberra’s nature reserves, on which the
ACT Government k
illing program has been implemented in recent years. Ecologist Ray
Mjadwesch has provide
d instruction to this group of concerned citizens. Information about
previous Canberra killing pr
ograms under FOI suggest the methodology of kangaroo counting
used by ACT Government officials is superficial and highly inaccurate, with gross
exaggeration. Additional advice on vegetation cover has also been obtained by those carrying
o
ut the independent community science kangaroo counts. The four teams of ACT citizens
co
ncerned about Canberra’s wildlife have used GPS, compasses, range finders and their
particul
ar knowledge of kangaroo behaviour to examine numbers of kangaroos and vegetation
on
11 nature reserves at various times throughout the day in various weather conditions, to be
sure that many of the typical influencing variables are accounted for. A total of 43 separate
s
urveys were undertaken across the
11 reserves by ACT citizens concerned about Canberras
w
ildlife. Detailed reports on the habitat condition of every nature reserve compiled by these
teams are current
ly being completed.

While the final writeup of research on the 11 nature reserves is not quite complete, the
attached table (Attachment 2) gives an indication of kangaroo densities based on the survey
work completed. This data,
using the higherlevel count estimate figures from the four teams,
s
hows alarmingly low kangaroo densities, giving rise to concern that at these levels there will
be no sustainability in kangaroo numbers and they will decline to mere remnant levels at best,
given the many other
threats to their habitat and movement. It is important to be aware that
kangaroos are highly stressed animals and the ACT citizens concerned about Canberra’s
wildlife all noted in their survey work the differing behaviour on those reserves where k
illing
and harassment of kangaroos has occ
urred. Post-traumatic stress is a significant determinant in
reduced wildlife procreation and this has been noticed on ACT reserves in the lower levels of
at
foot infant offspring.

Chief Minister, in earlier planning documents the ACT Government has said it wanted
to have kangaroo densities at around one kangaroo per hectare on its nature reserves. More
recently, your officia
ls have stated that your target is now 0.5 kangaroos per hectare, or in dry
s
heep equivalent grassland carrying capacity terms around onetenth of a single sheep per
hectare, or onethirtieth of a single cow. While these figures are ridiculously low for a soft-
footed native animal that has existed in this country for 16 mi
llion years, the data now being
collected t
hrough community science in the ACT now actually show much lower kangaroo
densities, with the highest kangaroo density being a mere (maximum estimate) 0.378 kangaroos
per hectare
. The Goorooyaroo nature reserve has an estimated maximum kangaroo density of
just 0.099. Chief Minister, this equates to around one fiftieth of one sheep and around a
h
undred and fiftieth of a single cow in grassland carrying capacity terms. The averag
e
kangaroo density over the
11 reserves is only 0.208. This is plain environmental van
dalism.

Chief Minister, each year when a kangaroo kill program is carried out the Government‘s
rhetoric is always about how humane it will be and that it is carried out by well
trained
professional shooters, who only need one clean shot to the brain for an instantaneous death
.

We now know this is completely false. You earlier received the autopsy report of a kangaroo
killed during the 2012 kill. This autopsy report was completed by internationally known and
highly respected wildlife and forensic veterinarian Dr Howard Ralph. While this report is for
o
nly one rescued body, it is highly likely that many other animals suffered the same pitiful and
cruel fate as this random example. There are many photos of kangaroos dug up from the burial
pit by activists last year that show miss
shots to the head. These photos are also attached
(
Attachment 4).

In Dr Ralphs forensic report of 4 June 2012 (Attachment 3), we would like you to
focus on the very last paragraph which states (inter alia):

The above series of lesions indicates that the kangaroo was first shot, then bludgeoned
on the head and then stabbed in the neck. The evidence is consistent with the kangaroo
being alive until finall
y being exsanguinated and asphyxiated by a laceration to the
t
hroat. The kangaroo very likely suffered severe pain and distress for some time during
this progressive attack, until the fatal exsanguination and asphyxiation.

Chief Minister, you cannot possibly ignore this kind of extreme brutality to a sentient
being. To do so would demonstrate the worst kind of human behaviour; in which a wider right
minded community would have serious misgivings about who they have in charge of their city.
I
n this regard we draw your attention to the recent Cambridge Declaration of eminent
n
euroscientists and neuropsychologists (2012) in the presence of Professor Stephen Hawking.
That Declaration states (inter alia):

... the weight of evidence indicates that humans are not unique in possessing the
neu
rological substrates that generate consciousness. Nonhuman animals, including all
mammals and bird
s, and many other creatures, including octopuses, also possess these
neuro
logical substrates.

Chief Minister, clearly some kangaroos are at risk on Canberra’s nature reserves due to
habitat destruction, shooting by surrounding rural lessee farmers, weed infestation and
continued harassment by humans and dogs. In those reserves where kangaroo safety is at risk
we favour translocation to more habitatfriendly places as an ethical, successful, nokill method
of manageme
nt. The research by Ray Mjadwesch, summarised in the attached report from him
(Attachment 1), suggests there are plenty of areas in the ACT to which kangaroos could be
mo
ved.

The success of kangaroo translocation has been demonstrated in peer-reviewed
literature and in a recent example in the ACT. Such success depends on it being done
sensiti
vely by people with experience in kangaroo behaviour and translocation, as well as skills
a
nd a licence in chemical immobilisation. It is now not accurate for your Government to say
that the tran
slocation of kangaroos cannot be successfully undertaken. Indeed Chief Minister,
the AJP’s senate candidate for the ACT in the forthcoming federal election, Marcus Fillinger, is
a
highly qualified and licenced expert in chemical immobilisation. There are few others that
can boast his level of expertise in this area and he is available in the ACT.

Chief Minister, the cost to the ACT ratepayer of the 2012 ACT Government killing
program was more than $215000, or more than $186 for each of the 1154 kangaroos you had
slaughtered. Based on the costs of a recent kangaroo translocation program within the ACT
that had a one hundred per cent success rate, we know the cost of a nokill approach through
translocation is just
$24.20 per translocated kangaroo. Chief Minister, this cost is six times less
expen
sive than what you have spent on your killing program.

The cost savings of translocation rather than killing, include no need for security
per
sonnel and police, their travel and accommodation, no need for shooters, their travel and
acco
mmodation, no need for government rangers, no need for ammunition, no need for heavy
excava
tion equipment for burial pits, no need to close the nature reserves to the general public
for a continuous period, and no need to hire intensifier night vision / thermal imaging
equipment or encumber vital imaging assets from emergency services whi
ch in turn could cost
the lives of the gener
al public in an emergency.

Other benefits include avoidance of significantly increased protests and growing negative
p
ublic opinion, and learning about how to save animal lives, which requires considerably more
skill and knowledge than simp
ly killing.

Chief Minister, we have one other significant concern about the actions your
Govern
ment has taken with respect to kangaroo killing in the ACT and the recent statements by
Greens Minister Mr Rattenbury that
a cull is necessary. In a world where daily news about
violence has become all
consuming there is now peer-reviewed evidence that brutality to
a
nimals, and the depiction and support for animal brutality, leads to violence and cruelty by
humans against humans in our co
mmunities. For this additional reason it is not alright to
brutalise kangaroos as has occurred in Canberra in the past five years.

Chief Minister, in the past your Government has stated that in killing kangaroos it
applie
s the precautionary principlein relation to other ecological elements in the ACT. There
has ne
ver been any causal evidence that kangaroos have a deleterious impact on this ecology –
it is
purely associative evidence, which is not satisfactory in defending a program of native
animal killing on ecological grounds. Simple photographs of a fenced and unfenced area of
grassland are fa
r from sufficient scientific evidence. Chief Minister, if we are to operate under
t
he ‘precautionary principle’, let us have scientific uncertainty and growing public concern
resol
ved by detailed and independent analysis. In that regard a moratorium is the only decision
t
hat can be made. You will lose no votes with such a decision. How ‘true blue’ will you be in
thi
s year of ACT centenary?

  • Kangaroos in the ACT – a predicted model of distribution and abundance.
  • Attached graphic illustrates a model for distribution of Eastern Grey Kangaroos in the ACT in 2013,
    based on kangaroo observations (Atlas of Living Australia (light blue triangles), scientific studies
    (blue triangles) and community reports (pink triangles)), land-use, vegetation type and terrain
    phys
    iognomy.
    Green indicates that suitable habitat exists in the unit, and there is protection for kangaroos (national
    park
    / conservation reserve). These units include open grasslands such as at Tidbinbilla, as well as
    higher ranges comprising grassy forests, however it may be that wildfire has removed kangaroos
    from some of the illustrated situations. If kangaroos persist they could be expected to occur at near-
    normal densities in optimal habitat areas
    (between 200-450 / km2, possibly at lower densities in sub-
    optima
    l habitats).

    Note that green does not indicate that the whole square is suitable habitat, it just indicates that
    some of the square is potential habitat
    , and in this section of the square kangaroos can be expected
    to
    persist at something approximating 1788 densities. In the south of the ACT (Namadji National
    Park) the green is based on Banks descriptions of abundantkangaroos at his 4 study sites (2001).

    Orange indicates locations where kangaroos generally persist in landscapes where they are not
    protected, and where they are subject to impacts of human occupation, including rural lands,
    remnants adjoining urban development or land bounded / bisected by roads, and conservation
    r
    eserves in which shooting occurs. These areas formerly represented optimal kangaroo habitat
    (expected 1788 densities 200-450 / km2), and this made these lands a target for agricultural
    deve
    lopment historically. Given stated densities in these regions (TAMS KMP 2010) of around 40/
    k
    m2 (in 1997) and a target density of 0.5/ha in the urban reserves, reductions in these areas could
    be expected to be in the order of 80-90%.

    Red indicates landscapes where kangaroos are under extinction pressure. This unit includes small
    isola
    ted remnants, and cleared lands adjoining known / occupied areas and remnants. Kangaroos in
    these areas are often in trouble (on roadsides, trying to navigate their way through cleared farmland
    / fences, etc), and are likely to have experienced decline in the order of up to 99% (may persist at
    densit
    ies of 1-5 / km2).

    Black indicates areas where kangaroos are presumed extinct (likely 100% reduction). These areas
    a
    re typically highly fertile landscapes, historically given to agricultural, and urban development,
    including the CBD and suburbs, airport, highly modified agricultural landscapes etc. These units
    would
    previously have supported 200450 kangaroos / km2.

    Gold indicates pine plantations. While kangaroos can persist in pine plantations, when harvesting
    occ
    urs this is highly disruptive to populations, which generally disperse into surrounding landscapes
    with often poor outcomes on local roads and in fences. Vegetation clearing also drives kangaroos
    into neighbouring farmland, where they are frequently shot, and the cycle of pine planting and
    harvesting, oft repeated, can push populations to critically low levels or extinction. For the purposes
    o
    f this discussion Eastern Grey Kangaroo densities in pine plantations are estimated to be 90%
    r
    educed from 1788 levels.

    White indicates habitats typically unused by Eastern Grey Kangaroos, principally on account of
    steep terrain and generally unsuitable vegetation types being present. Dispersing animals may
    sometimes be encountered in these habitats in low densities (negligible contribution to total for the
    ACT).

    There are additional layers I would like to add to this graphic, including a density distribution map of
    shoo
    ting statistics across the ACT (for the purposes of “damage mitigationand conservation
    c
    ulling), to further illustrate the pattern of persecution across the territory. Further refinement of the
    pred
    ictive model based on vegetation mapping of the ACT would also be an objective to finalise this
    direction of my investigation, with reference to http://http://www.anra.gov.au/topics/vegetation/extentlactlindex.html.ln
    a
    ddition there may be natural altitudinallimits to their distribution (max height of observations c.
    1300m at Bulls Head), which I have not taken into consideration in predicting their possible
    distribution through the high country.

    I am also in receipt of 46 data sets and hundreds of photos from community surveys across the
    urban reserves, on which basis density calculations and population estimates are being produced.
    Th
    ese do seem to vary significantly from the various TAMS pellet count and community survey
    esti
    mates. All of this is obviously a lot of work to do however, particularly in an unpaid capacity, and
    as I have paid contracts which require my attention at the moment, it will take some time to
    incorporate these additional determinants into the model.

    In the interim, the following summary provides an indicator of the order of magnitude of decline in
    kangaroos in the ACT:

    • 28.3% of the ACT is unsuitable habitat for Eastern Grey Kangaroos on account of steep
      terrain, incorrect vegetation types etc
    • Eastern Grey Kangaroos are extinct from 20.5% of the ACT, on account of human
      occupation (city and urban areas, and heavily modified rural landscapes)
      • Kangaroos are under pressure across 29.9% of the ACT, from agriculture (loss of habitat
        and shooting), shooting in reserves, and from softwood industry (loss of habitat / disruption)
      • Kangaroo habitat in which they are effectively conserved now occupies only 21.3% of
        Aust
        ralias capital territory, down from 71.7% of the ACT in 1788.

    Overall kangaroo decline (simple reduction in distribution and abundance) across the ACT is
    expected to be in the order of 75.8%.

    I have tried to be optimistic in allocating green to squares in the south of the study area, to ensure
    t
    hat kangaroo distribution is not underestimated. It may be that tracts of potential habitat through
    places like Emu Flat and Kangaroo Creek actually have no kangaroos, in which case the magnitude
    o
    f decline will be greater than indicated above. If you just consider the top half of the ACT (down to
    line 44) the order of predicted decline runs at around 88%.

    Apart from page 15 of the TAMS KMP (2010) which obviates the need for further discussion on this
    top
    ic (picture of ideal habitat“, but where are the kangaroos?), an irresolvable contradiction within
    the culling program is simply demonstrated by the statement in the ACT kangaroo shooting program
    promotional
    information, which describes kangaroos at densities of up to and exceeding 450/ km2
    a
    t Yankee Hat without any significant impact on grassland / woodland conservation values.

    Simultaneously impacts on grasslands by over-abundant populationsis exactly the reason cited for
    th
    eir shooting in and around the city reserves, where TAMS have identified initial densities of only
    154
    355 I km2, with aspirationall target densities of only 50-160 / km2 being described as
    sustainable” .

    The ACT Government and TAMS are faced with a stark choice.

  1. Continue with an unpopular and seemingly unjustifiable program of shooting, even in the face of
    emerging evidence clearly indicating significant and continuing decline in the subject species, or
  2. Operate under the precautionary principle, where scientific uncertainty can be resolved by
    detai
    led and independent analysis of the findings of Or Fletcher, and of a parallel community
    driven study on the kangaroos of the parks and reserves of the city precincts (in prep).

Given the amount of shooting which has already occurred (up to 80% of animals have been shot in
some reserves
), not shooting the kangaroos in the parks and reserves for a year, while this issue is
reso
lved, is not going to cause irreparable damage to ecosystems, which are reported to be affected
by the so-called
over-abundantkangaroos.

Or Fletcher’s local knowledge and input would be welcome, to further refine the attached predictive
mode
l for kangaroos in the ACT. It would be expected that groundtruthing sections of the landscape
and do
ing density studies in different land systems (for example pine forests) would allow more
accurate estimates
to be made. It may be that a simple walk to somewhere like Square Rock (L46)
would
render several green squares white (on account of habitat being unsuitable), for example.
Obviously further careful consideration of these and other factors affecting kangaroos across the
ACT wi
ll be required before there can be concluding statements on the situation there, however
initial impressions are cause for serious concern.

It should be remembered that the attached model is a startpoint for quantifying the distribution and
abundance of t
his iconic species across the ACT, in the face of ever-intensifying human impact, in
o
rder to initiate discussion about conservation of a species at risk.

In the longer term it seems inevitable that the future for kangaroos in the reserves of the city
precinc
ts will be untenable. Their decline as suburbs continue to swallow land, and their fate as they
are
forced onto roads and through fences is not a kind one, as groups are broken up and dispersed,
and as they are run over, chased by dogs and caught in fences. The current situation also places an
unfai
r onus of responsibility on wildlife rescuers and carers in the region.

The attached graphic illustrates the solution, as well as the problem, however. Populations
pers
isting in isolation (such as Crace, Mulligans, Majura, the Pinnacle, Mt Painter etc) may require
relocating for their o
wn sake; there seem to be ample landscapes within the system of reserves in
the ACT
to accommodate them.

A translocation program, including construction of release compounds and running a monitoring
prog
ram, should not exceed the current shooting budget, while providing a safe, humane and long
term solution to the problems faced by the kangaroos (and their managers) in and around Canberra.
Where locals do like and want their kangaroos, these communities will require assistance in
managing and protecting populations.

    REPORT PERTAINING TO EASTERN GREY KANGAROO

    On 4 June 2012, I was requested to conduct a post mortem examination on a young,
    male Eastern Grey Kangaroo. The kangaroo weighed 16kg.

    POST MORTEM EXAMINATION

    The nutritional status of the kangaroo was adequate.

    The kangaroo was externally moist and the fur contained a considerable amount of
    dried and moist di
    rt in small rolled balls attached to the fur. There was blood partly
    cover
    ing the head, neck, front legs and chest. There were several wounds evident
    on the head and neck.

    The first of these wounds was a small (0.5 to 1.0 cm diameter) rounded hole that
    penetrated deeply into the tissue at the level
    of the zygomatic arch and mid distance
    between the r
    ight eye and the right ear. The penetration progressed in a line from

    the small hole, through the soft tissue of the temporal, masseter and facial muscles
    and out through the lateral area that was originally the mandible. That area showed a
    large (6
    x 5 cm), irregular wound containing remnants of soft tissue and multiple small
    fragments of mandibular bone and teeth
    . The original structure of the mandible and
    teeth was totally disrupted. There two wounds are consistent with a bullet wound
    entry above and exit below
    .

    The second wound was at the posterodorsal (back and top) aspect of the head.
    There was conside
    rable crepitus (crunching sensation) on palpation of the skull and
    the cran
    ium was deformed and not intact. Incision over the scalp revealed
    haemorrhage benea
    th the skin and multiple fractures of the cranial (skull) bone.


  • These bone fragments were easily moved to display a large amount of haemorrhage
    within the skull and brain. The brain showed considerable external haemorrhage with
    some also in the ventricles and brain substance
    . This injury is consistent with a
    crushing, blunt trauma to the skull and brain.

    The third wound was on the right side of the neck about 4cm distal to the angle of
    the mandible (point of the jaw)
    , 3 to 4cm from dorsal (top) to ventral (bottom) and
    2cm wide at the centre. The edges of the wound were regular and smooth consistent
    with a sharp knife entry wound
    . Within the wound there was blood from the jugular
    vein
    , carotid artery and other smaller vessel that had been severed. A number of
    muscles were divided (severed). The trachea was divided (severed) leaving a
    smooth surface on each fragment
    . There was blood in both sections of the trachea
    and extending down into the bronchi
    .

    The skin of the neck was retracted and revealed subcutaneous haemorrhage
    extending from the posterior skull along the dorsum (top) of the cervical area to
    almost the level of the scapula and shoulder. This indicated that there was bleeding
    from the head wounds during life.

    The chest cavity was opened and contained lungs that partly contained air and partly
    conta
    ined blood particularly on the right. The distribution of the air was consistent
    with aspiration of blood during breathing
    .

    The abdomen, hind limbs and lumbosacral spine were examined and did not reveal
    any abnormality
    .

    INTERPRETATION

    The first wound to the face was consistent with a gunshot from above, the bullet
    entering at the dorsal part of the r
    ight hand side and exiting at the level of the
    mandible and causing massive damage to that bone and teeth. That was likely to be
    the primary wound of a series of three wounds and is not likely to have been fatal
    .

    The second wound, to the skull and brain, caused extensive trauma/damage to both
    struc
    tures and is consistent with blunt trauma caused by a blow with a heavy object.
    Considering the bleeding along the dorsum of the neck and the series of three
    assaults on this kangaroo
    , this trauma to the head was unlikely to have caused
    immediate death.

    The third wound is consistent with a penetrating knife wound to the neck. The skin,
    muscle, vessels and trachea were divided in such a manner as to be also consistent
    with a deep kni
    fe injury. The presence of blood aspirated into the trachea, bronchi
    and lung is consistent with aspiration before death
    .

    The above series of lesions indicates that the kangaroo was first shot, then
    bludgeoned on the head and then stabbed i
    n the neck. The evidence is consistent
    w
    ith the kangaroo being alive until finally being exsanguinated and asphyxiated by a
    laceration to the t
    hroat. The kangaroo very likely suffered severe pain and distress
    fo
    r some time during this progressive attack, until the fatal exsanguination and
    asphyxiation.

    The following graphic and distressing images of slaughtered Eastern Grey kangaroos are a
    sample of that taken at the Kama Nature Reserve burial pit
    .

    The images show kangaroos having being shot through the jaw and neck, despite ACT
    Go
    vernment claims that kangaroos are killed by a single lethal shot to the head by expert
    marksmen.

    The images show infants having had their heads sawn off, in what must be considered a highly
    brutal
    and violent act. The images also show the bodies of a high proportion of viable kangaroo
    young
    (approximate weight 500 grams) despite statements by the ACT Government that such
    culls are undert
    aken during May to avoid inpouch joeys being impacted on by such killing
    programs
    .
